Types Of Immigration Status And Their Rights In The United States II

Asylum Seeker or Refugee:

Also called Temporary Protected Status (TPS), these individuals have fled their home countries due to persecution, violence, or other dangers. They seek protection and legal status in a new country, often through asylum or refugee status.

  • This category of Visa is Provided to nationals of certain countries due to unsafe conditions.
  • They are protected from deportation but also with no path to permanent residency.
  • They must have advanced parole to travel.
  • They are granted temporary authorization to work in U.S.
  • Their status is reviewed periodically.

Undocumented or Unauthorized Immigrant:

People who are in a country without legal authorization or overstaying their visas are considered undocumented or unauthorized immigrants. They often face legal challenges and limitations on access to services. They are also called no lawful status.

  • They do not possess valid immigration documents or violated terms.
  • They are not authorized to work in the U.S.
  • They run the risk of being deported.

DACA Recipient:

In the United States, DACA (Deferred Action for Childhood Arrivals) recipients are individuals who were brought to the country as children and have received temporary protection from deportation and work permits, they are granted right to education and medical care. They can travel outside of the US with permission. There is no direct path to citizenship for DACA recipients.

To be eligible for DACA, individuals must meet specific criteria, including:

  • Arriving in the U.S. before the age of 16.
  • Continuously residing in the U.S. since June 15, 2007.
  • Being physically present in the U.S. at the time of applying for DACA.
  • Graduating from high school, obtaining a GED, or being honorably discharged from the military.
  • Not having certain criminal convictions.

However, DACA has now been ruled illegal by a Texas Judge at the time of this article, is still being reviewed.
